- Impact Fee Ordinances - Refund Provisions - Date: August 2011
Question: If your county's impact fee ordinance requires that funds be spent or encumbered within a specified period of time, what happens if the funds are not spent/encumbered within the period of time? If the answer is a refund, does your county's ordinance (or related resolution/policy) establish the procedure? Does your county automatically refund the money? Does the feepayer (or property owner) have to apply for a refund? If there is a refund application process, does your county provide notice to the feepayer or property owner of the process? If so, at what stage? If there is a refund application process, is there a limited time period in which the application must be made? If there are time limits on the refund application, is there an implied waiver to the refund if the application time period expires without a claim?
